Guiding You Through Your Property Purchase in Victoria

Buying a property is one of the most exciting milestones in life. It can also be a complex journey with significant legal and financial steps. At Star Property Conveyancing, our goal is to provide you with expert guidance and support, ensuring your purchase is smooth, secure, and stress-free from the moment you find your ideal home to the day you get the keys.

Before You Sign: The Importance of a Professional Review

Before you sign a Contract of Sale, it is absolutely essential to have it professionally reviewed by a conveyancer. The contract and the accompanying Section 32 Vendor Statement contain critical information that can significantly impact your purchase.

Our pre-signing review includes a thorough check of:

  • The Certificate of Title for any restrictions, covenants, or easements.
  • The accuracy and completeness of the Section 32 Statement.
  • The fairness of any special conditions.
  • Zoning, council rates, and water information.
  • Owners Corporation details (if applicable).

This crucial step protects you from potential pitfalls and ensures you are making a fully informed decision.

What are the total costs to buy a house?

Beyond the sale price, you’ll have costs like government stamp duty and transfer fees. We provide a clear, fixed-fee quote for our services and can identify any stamp duty concessions you’re entitled to. Contact us for a detailed breakdown tailored to your specific purchase.

What red flags do you look for in a Section 32?

The Section 32 can hide costly issues like illegal building works or restrictions on how you can use the land. Our expert review protects you from these hidden risks. Before you sign anything, let us check the documents to ensure your investment is secure.

Can I get out of a contract if my finance fails?

Yes, but only if your contract has a properly drafted “subject to finance” clause. This is different from the standard 3-day cooling-off period and is your most important financial safety net. Contact us to ensure your contract gives you the protection you need.

How long does settlement take?

Settlement is typically 30 to 90 days. During this time, we manage all the critical steps, from coordinating with your bank to preparing all legal documents, to ensure a smooth and on-time completion. To understand the specific timeline for your property, get in touch with our team.

What does a conveyancer actually do for me?

As your licensed conveyancer, we are your dedicated specialist for the entire property transfer process. We manage all the complex paperwork, coordinate with all parties, and ensure the legal ownership of the property becomes yours, securely and stress-free. 1. Contract and Section 32 Review

We provide a detailed review of the legal documents and give you clear advice before you make an offer or sign anything.

2. Negotiation and Signing

We can assist in drafting special conditions to protect your interests (e.g., “subject to finance,” “subject to building and pest inspection”) and will guide you through the process of signing the contract correctly.

3. Post-Signing: Finance and Inspections

Once the contract is signed by both parties, the cooling-off period (if applicable) begins. This is the critical time to secure unconditional finance approval from your lender and arrange for any building and pest inspections.

4. Pre-Settlement Preparations

We handle all the essential background work. This includes conducting all necessary property and title searches, liaising with your incoming lender, calculating the stamp duty and any concessions you may be eligible for, and preparing the final settlement figures, which include adjustments for council and water rates.

5. The Final Inspection

We will remind you to arrange a final inspection of the property with the real estate agent in the week leading up to settlement. This is to ensure the property is in the same condition as when you first inspected it.

6. Settlement Day

Settlement is completed electronically through PEXA (Property Exchange Australia). We represent you in this online transaction, ensuring the funds from your lender are paid to the seller in exchange for the clear title to your new property.

7. Post-Settlement Confirmation

Once settlement is complete, we notify you and the real estate agent immediately, so you can collect the keys. We also inform the local council and water authorities of the change in ownership on your behalf.
